Terms of Service

By accessing or using PikoTV's services, websites, applications, or any related products (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

These Terms constitute a legally binding agreement between you (whether personally or on behalf of an entity) and PikoTV Teknoloji A.Ş. ("PikoTV," "we," "us," or "our") concerning your access to and use of our Services.

You represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

PikoTV provides professional broadcasting solutions including, but not limited to:

• Video encoding and transcoding solutions
• Decoder and media gateway systems
• OTT (Over-The-Top) platform services
• IPTV and DVB broadcasting solutions
• Content delivery network (CDN) services
• Quality of Service (QoS) and Quality of Experience (QoE) monitoring
• RF Network Management Systems
• End-user ecosystem devices and set-top boxes
• Technical support and maintenance services

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.

To access certain features of our Services, you may be required to create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or security breach

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activities.

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Distribute malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity or performance of our Services
• Reverse engineer, decompile, or disassemble any part of our Services
• Use our Services to infringe upon intellectual property rights
• Resell or redistribute our Services without authorization
• Use automated systems to access our Services without permission

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof, are the exclusive property of PikoTV or its licensors and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

The PikoTV name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of PikoTV or its affiliates. You may not use such marks without our prior written permission.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your internal business purposes.

For paid Services, you agree to pay all fees and charges associated with your account on a timely basis and with a valid payment method. All fees are exclusive of applicable taxes unless otherwise stated.

• Pricing: Prices for our Services are subject to change. We will provide notice of any price changes before they take effect.
• Billing: You authorize us to charge your designated payment method for all fees incurred.
• Refunds: Refund policies vary by service and are specified in individual service agreements.
• Late Payments: Late payments may result in service suspension and may incur additional fees.

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Services will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Services will be accurate or reliable
• Any errors in the Services will be corrected

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIKOTV AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless PikoTV and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Services
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Any content you submit, post, or transmit through the Services

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

• Your right to use the Services will immediately cease
• We may delete or deactivate your account and all related information
• Provisions that by their nature should survive termination shall survive

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Services shall be resolved exclusively in the courts of Istanbul, Turkey. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of the Services after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Services.
